The Supreme Court recently upheld the Illinois Supreme Court ruling that threw out a $10.1 Billion verdict of "light" cigarettes.

In March 2003, an Illinois judge ruled against the tobacco companies saying customers were misled into believing they were buying less harmful cigarettes and awarded a $10.1 billion verdict. In 2005, The Illinois Supreme Court threw out the massive fraud judgment against Phillip Morris, in a class-action lawsuit involving "light" cigarettes.

Federal Trade commission allows companies to characterize cigarettes as "Light" and "Low Tar"; accordingly Phillip Morris cannot for "false or misleading" advertisement under state law.
