A lawsuit filed against Royal Caribbean by the family of Gregory A. Smith, IV, who disappeared from a honeymoon has been dismissed by a Miami judge.

Maritime lawyer, Brett Rivkind told reporters although this a setback, the issue is going to be decided in an appellate court.

Smith, of Greenwich, disappeared from the Brilliance of the Seas while on a honeymoon cruise in the Aegean Sea in 2005. Although his body was never recovered, bloodstains were found on an awning underneath the newlywed's cabin balcony.

This case is still under investigation by the FBI. Smith's parents believe he was murdered. They filed the lawsuit alleging the cruise company covered up the incident to avoid negative publicity and liability. The Cruise line states they exceed all legal requirement when the FBI and other authorities were contact immediately.
