Florida lawsuits against tobacco companies for injured smoker's takes a major turn in favor for tobacco companies. Recently the Florida Supreme Court dismissed a $145 billion verdict for punitive damages stating the verdict was excessive.

The Supreme Court also approved an appellate court ruling that it had been a mistake to certify a class-action lawsuit representing an estimated 300,000 to 700,000 ill Floridians that resulted in the huge jury award for punitive damages in 2000
. The courts further upheld the jury's finding that
companies had negligently misled the public regarding the dangers and addictive nature
, thereby opening the door for these individuals to file a separate lawsuit within one year.

However the courts reinstated $2.85 million award to cancer stricken smokers, Mary Farnan and a $4.023 million award to Angie Della Vecchia, who started smoking at age 11 and died in 1999. The Courts did not restore Frank Amondeo's the $5.8 million award on the basis it fell outside the statute of limitation.
